NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. This Contest begins on January 1, 2022 and ends on January 2, 2023.
Capital Resorts Group, LLC d/b/a Capital Vacations (“Sponsor”), 2024 Corporate Centre Dr, Suite 101, Myrtle Beach, SC 29577. Eligibility: This contest is void where prohibited by law and is not directed towards residents of any jurisdiction in which registration and/or licensing is required but in which such registration and/or licensing requirements have not been met. This contest is open to legal residents of the U.S. and District of Columbia who are at least twenty-one (21) years old. By entering this contest, you (“Entrant”) agree to the terms and conditions set forth herein and Entrant is responsible for understanding their rights. Employees, officers, directors, agents, representatives, and their immediate family and/or household members (whether or not related) of Sponsor, its affiliates, and its agents are not eligible. This Contest is subject to all applicable U.S. federal, state, and local laws and regulations. By submitting an entry, entrant fully and unconditionally agrees to accept, and waive any right to ambiguity in, the Contest and these Rules. Sponsor reserves the right to cancel or amend the Contest and/or the terms and conditions, and it is Entrant's responsibility to ensure they stay informed and up to date with these terms and conditions.
Complete a Contest Entry Form online at https://www.capitalvacationscontest.com and submit a photo from your 2022 vacation at an Eligible Resort. Proof of electronic submission does not constitute proof of entry. The name, address, telephone number(s), and email address (collectively, “Contact Information”) provided by each entrant in the Contest Entry Form is the contact information of record regarding all communications with each Entrant; any changes to such contact information may serve as a basis for disqualification. Each Entrant must be the rightful owner (or have authorized use) at time of entry of the email address listed on the entry form. If there's a dispute as to a winner's identity, the winner will be deemed to be the person in whose name the e-mail account for the email address was opened (Sponsor may require proof thereof). Entrants must provide all Contact Information to be eligible to win, and consents to Sponsor's use of Contact Information for Contest administration and prize fulfillment.
Photos submitted are considered to be licensed by the Entrant to the Sponsor and its affiliates, in perpetuity. By entering the photo contest, the Entrant is granting the Sponsor and its affiliates a non-irrevocable license for the right to use the Entrant's photos in and for all marketing activities and promotional purposes to promote Capital Vacations™. Entrant will retain the full copyright to any photograph submitted. Entrant is granting the Sponsor's rights to Entrant's photograph royalty-free, in perpetuity, non-exclusively, including, but not limited to, the following uses:
By submitting a photo and entering into the Contest, Entrant is expressly representing and warranting the following: (1) Entrant is the only author of the photo and this is your original work; (2) Entrant is the sole copyright holder of the photo being submitted; (3) Entrant has not licensed any rights in the photo that will conflict with the usage rights required by our company; (4) Entrant has the permission of any persons in the photo, or if they are under 16, the consent of their parent or guardian to grant the usage rights required by this contest; (5) That entrant's photo does not include trademarks, contract rights, or any other intellectual property rights of any other third person or entity; (6) That entrant's photo does not contain names, likenesses, or other characteristics identifying celebrities or other public figures, living or dead; (7) Entrant acknowledges that it will be responsible for any claim made by any third party in respect of entrant's entry into Contest and to fully indemnify Sponsor, its parent company, and their respective subsidiaries, affiliates, officers, members, directors, employees and agents in respect of all royalties, fees and any other monies owing to any person or entity by reason of Entrant's breach of any of the foregoing.
By entering, participants agree to indemnify, defend and hold harmless the Sponsor, its parent company, and their respective subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives, from any and all third party liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the competition (collectively, “Losses”), including without limitation any third party claim for copyright infringement or a violation of an individual's right to privacy and/or publicity right. Contest entrants are responsible for ensuring that he or she has the right to submit the photos that he or she submits to the contest. Entrant acknowledges their responsibility for protecting their entry against image misuse by third parties, by, but not limited to, the insertion of a watermark, and that the Sponsor can assume no responsibility and are not liable for any image misuse.
There will be Sixteen (16) prizes given out throughout this Contest and there will be Sixteen (16) separate drawings. The prize schedule is:
Prizes cannot be transferred or substituted, except by Sponsor due to prize unavailability, in which event a prize of equal or greater value may be used. Travel must be completed within twelve (12) months of prize award date. Prize is subject to resort availability. Prize may not be redeemed for cash. Except where prohibited by law, winner's prize acceptance constitutes agreement for the Sponsor to use winner's name, photographs, likeness, statements, biographical information, voice, city, and state of residence for advertising purposes on a worldwide basis in all forms of media and on the internet, without compensation. Sponsor and its respective subsidiaries, affiliates, employees, officers, directors, shareholders, affiliates and agents (collectively “Related Parties”) are not responsible for and will not be liable for; (i) late, lost, damaged, misdirected, incomplete, unintelligible entries; (ii) telephone, electronic, hardware, software, network, Internet or computer malfunctions or transmission failures of any kind; (iii) any condition caused by events beyond the control of Sponsor that may cause Contest to be disrupted or corrupted; or (iv) printing or typographical errors in any Contest materials.
The winner will be selected from all eligible entries received, on the 30th day of each month. Winner will be notified by email or telephone, and must complete, execute and return a W-9 form (required to issue the winner's 1099 forms), an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release (collectively “Affidavits/Releases”) within 5 calendar days of notification in order to claim his/her prize. Failure to complete these steps within the 5-calendar day period may result in disqualification of the selected winner, and a new winner may be selected from eligible entries. Sponsors are not responsible and will not be liable for late, lost, misdirected or unsuccessful efforts to notify the winner. If the winner cannot be notified within 5 calendar days of selecting the winner, or fails to comply with these Rules, the winner will be disqualified, and an alternate winner will be selected. Subject to any required governmental approval, Sponsor reserves the right to, without prior notice and at any time, terminate, cancel, or modify the Contest, in whole or in part, if any factor interferes with its proper conduct as contemplated by these Rules or if it becomes technically corrupted or due to non-authorized human intervention. ENTRANT HEREBY WAIVES ALL RIGHTS TO BRING A CLASS ACTION SUIT OR TO CLAIM, PUNITIVE, INCIDENTAL, MULTIPLIED, INCREASED, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES, INCLUDING ATTORNEYS' FEES.
Winners' List: For winner's list, send a self-addressed stamped envelope to Sponsor, at the address above. Promotional Offers: By registering for this promotion and providing your consent and Contact Information (name, address, phone number(s) and email address) on the entry form, you (i) authorize Sponsor, Capital Resorts Group, LLC (“CRG”) and its agents to collect, use and disclose the personal information you provide to offer you vacation and travel promotions, products and services, including without limitation, the opportunity to purchase a CRG vacation package to a Capital Vacations Club (“CVC”) destination area or a CVC timeshare interest (collectively “Vacation Offers”), and (ii) expressly request and agree to be contacted by mail, email, and/or telephone at the addresses and/or numbers herein provided (including through the use of an automated and/ or predictive dialer, in which case a pre-recorded message may be left on your answering machine or voicemail by CRG and its affiliates and agents, concerning this and future promotions and Vacation Offers, where allowed by law.
